Cabinet passes memorandum on constitution-making process

The Governance Cluster in its meeting chaired by the First Vice President Dr. Riek Machar adopted the ministerial memorandum on the constitutional-making process on Tuesday.
The memorandum was presented by the Ministry of Justice and Constitutional Affairs Roben Madol.
The cluster discussed the progress report on the implementation of Chapters V, VI, and Article 1:17 regarding the establishment of the Judicial Reform Committee as per the Revitalised Agreement on the Resolution of Conflict in South Sudan.
The Minister of Cabinet Affairs Martin Elia Lomuro said the three Chapters adopted were vital in the Revitalised Peace Agreement.
“The Council of Ministers had directed the Minister of Justice and Constitutional Affairs to trigger the implementation of Chapters V, VI and also Chapter 1:17 on the establishment of the judicial reform committee.
“These are important chapters of the Revitalised Agreement on the Resolution of Conflict in the Republic of South Sudan,” Dr. Lomuro said.
The Governance Cluster acknowledged several accomplishments by Mr. Madol including the formation of the Commission for Truth and Reconciliation that comprised 34 members.
“The committee has elected its chair to pass its operational plans and terms of reference. It is now waiting for training and once they are trained, they will now go out there to do the consultation in areas where the war was prevalent during 2013,’’ he said.
He went on to reveal that the commission would also “do consultations in IDP camps, other South Sudanese and government institutions, society and women and youth to document their testimonies over the period’’.
Dr. Lomuro said the committee would carry out consultations within one month after which it would deliver its findings to the council of ministers.
The council will then constitute the bill that will be drafted to manage the commission for Truth, Reconciliation, and Healing.
He said the ministry of justice had drafted the bill following the resolutions of the workshop.
Plans on course
Lomuro said Madol had also briefed the Governance Cluster on the formation of the Judicial Reform Committee, which had already developed terms of reference, signed by the Minister in collaboration with IGAD.
“This is a committee that is to be chaired and deputized by foreign partners. So, the minister is waiting for IGAD now to make nominations for those members who will participate in the Judicial Reform Committee. I think that is also a very good development,” he said.
He said that the council had directed the Ministry of Finance to respond for there would be numerous monetary challenges for the commission for truth and reconciliation to kickstart its operations and the Judicial reform committee and the National Human Rights Advisory council to operate.
Resolutions
The Minister for Petroleum Puot Kang Chuol also briefed the Governance Cluster on the implementation of the Resolutions of the Council of Ministers on the improvement of the oil sector.
The resolutions were on Unified Human Resources Management Policy Manual 2020, Cost Audit Recovery, Local Content Regulations 2019, and the Environmental Audit. The Cluster was also briefed by Deng Dau Deng, the Deputy Minister for Foreign Affairs and International Cooperation on his participation in the 72nd Annual Session of the UNHCR’s Executive Committee that was held from 4-October 8, 2021 in Geneva, Switzerland.
The Cabinet Affairs Minister said the meeting passed the Unified Resources Management Policy which mandated South Sudanese in the oil production sector to proper or equal pay to the international partners to accord employees equal pay.
“There is also a resolution of Council of Ministers on cost audit recovery, that means money that was for production but not used for production should be given back to the Republic of South Sudan,” he added.
He said that the Minister of Petroleum vowed to pursue the implementation of the resolutions calling them sovereign resolutions of the nation based on the constitution. He urged the petroleum-producing companies to cooperate with the minister in making the resolutions a reality.
